OSHA coverage under the OSH Act can come in two ways: either directly from federal OSHA enforcing standards, or through an OSHA-approved state program that runs its own enforcement and standards as long as the state plan is at least as effective as federal requirements. In states with an approved plan, that state agency takes the lead, with federal OSHA providing oversight and stepping in if needed. In states without an approved plan, federal OSHA enforces standards there. A private contractor safety program is not a mechanism for how OSHA provides coverage under the OSH Act.
